Our Public Law Litigation Expertise

We are experts in public law litigation.

Our services:

  • Merits review: We either bring or defend challenges to government decisions brought in tribunals or before other administrative bodies
  • Judicial review: We act in judicial review challenges to decisions made by government agencies
  • Constitutional challenges: We act in constitutional challenges, including in the High Court
  • Proceedings in international tribunals: We act in international tribunal proceedings, with a particular focus on human rights bodies and investor/state disputes.

Our approach is pragmatic and strategic.  We treat litigation as a means and not an end.

Our principal has acted in some of the most important and contentious test cases of the last decade. These include:

  • Acting for the National Disability Insurance Agency in proceedings before the Full Bench of the Federal Court that set the limits of merits review rights under the National Disability Insurance Scheme. This decision directly impacts over half a million Australians

  • Acting for the NSW Independent Commission Against Corruption in proceedings that successfully defended landmark corruption findings made against a former NSW Minister Eddie Obeid – this is now a leading decision on procedural fairness and misfeasance in public office.
